At Sakura Health, Inc. ("Sakura Health," "we," or "us"), we take your privacy seriously. Please read this Privacy Policy to learn how we treat your Personal Data (as defined below). This Privacy Policy addresses how we treat the Personal Data of visitors to sakurahealth.ai ("Website Visitors") and is meant to help the healthcare specialists, professionals, providers, organizations, and their agents or affiliates ("Healthcare Professionals") that access our platform and use our Services understand how we treat their Personal Data.
As we continually work to improve our Services, we may need to change this Privacy Policy from time to time. Upon such changes, we will alert you by placing a notice on the Sakura Health website, by sending you an email, or by some other means. If you use the Services after any changes to the Privacy Policy have been posted, that means you agree to the changes.
This Privacy Policy describes how we collect, use, disclose, and protect your Personal Data. It applies to Personal Data processed by us in connection with providing our Services or engaging in written or electronic communications with you. "Personal Data" means any information that identifies or relates to a particular individual, including information referred to as "personally identifiable information" or "personal information" under applicable data privacy laws.
Sakura Health's products are a business-to-business offering, and in the ordinary course of providing those products we may process data at the direction of our customers. This Privacy Policy does not describe how we collect or use individuals' "Protected Health Information" or "PHI" (as defined by the Health Insurance Portability and Accountability Act of 1996, "HIPAA"). Specifically, when (a) Sakura Health, acting as a "Business Associate" (as defined in HIPAA), receives identifiable health information about an individual from or on behalf of one of our customers, and (b) such customer is a "Covered Entity" (as defined in HIPAA), that information is considered PHI and is governed by our Business Associate Agreement with that customer, not by this Privacy Policy. Personal Data provided to Sakura Health outside of that context is not PHI. For example, when you request a demo, create an account, use our tools, or send us an email, that information is not PHI. Please read the Notice of Privacy Practices of your healthcare provider to understand how your PHI may be used and disclosed.
This Privacy Policy does not cover the practices of companies we do not own or control, such as our customers, or people we do not manage.
From Healthcare Professionals and account users, we collect: profile and contact data (first and last name, email, business phone number, business mailing address); account credentials (username and similar identifiers); professional information you choose to provide; device and IP data (IP address, device, operating system, and browser type); and web analytics (page interactions, referring source, and usage statistics).
From Website Visitors and demo requesters, we collect: profile and contact data (first and last name, email, and, if you provide it, mobile phone number); information you submit through our demo request or contact forms; device and IP data; and web analytics. Providing your mobile phone number is optional.
We collect Personal Data from you directly (when you submit forms, create an account, or contact us), automatically through cookies and similar technologies when you use the Services, and from third parties such as our analytics providers and business partners.
We use Personal Data to provide, customize, and improve the Services; to create and manage accounts; to respond to your requests and inquiries, including scheduling and following up on demos; to communicate with you about Sakura Health and the Services according to your preferences; for security, fraud prevention, and debugging; and to meet our legal obligations and enforce our terms. We will not collect additional categories of Personal Data, or use the Personal Data we collect for materially different, unrelated, or incompatible purposes, without providing you notice.
If you provide your mobile phone number and opt in, we may send you text messages related to your request or your relationship with us, such as demo confirmations, scheduling and reminder messages, and follow-up messages related to your inquiry. Message frequency varies. Message and data rates may apply. You can reply STOP at any time to opt out of text messages, or HELP for assistance.
We do not sell, rent, or share your mobile phone number or your SMS opt-in with any third party for their own marketing purposes. Mobile information collected for the purpose of sending text messages is used only to deliver the messages you have requested and is not shared with third parties or affiliates for marketing or promotional purposes. We share it only with the service providers that help us deliver the messaging (for example, our telecommunications and messaging vendors), and only as needed to provide the service.
We disclose your Personal Data to: service providers that help us provide the Services or perform business functions on our behalf, including hosting, technology, and communication providers, security and fraud-prevention consultants, and support vendors; analytics partners that help us understand how the Services are used; business partners with whom you have a relationship, such as our customers; and parties you authorize to access your information.
We may also share Personal Data to comply with applicable law, regulation, court order, or legal process; to protect the rights, property, or safety of you, Sakura Health, or others; to enforce our agreements; and to resolve disputes. If we undergo a merger, acquisition, bankruptcy, or other transaction in which a third party assumes control of our business, your Personal Data may be transferred as part of that transaction, and we will make reasonable efforts to notify you beforehand.
We may create aggregated, de-identified, or anonymized data from the Personal Data we collect and use or share it for our lawful business purposes, provided we do not share it in a manner that could identify you.
The Services use cookies and similar technologies (collectively, "Cookies") to recognize your browser, understand how and when you use our Services, analyze trends, and operate and improve the Services. We use essential Cookies (required for core features), functional Cookies (to remember your choices), and performance/analytical Cookies (to understand usage, including through providers such as Google Analytics). You can control Cookies through your browser settings; disabling some Cookies may make certain features unavailable. Because of our use of Cookies, the Services do not respond to "Do Not Track" signals at this time.
We seek to protect your Personal Data from unauthorized access, use, and disclosure using appropriate physical, technical, organizational, and administrative security measures based on the type of Personal Data and how we process it. No method of transmitting or storing data is completely secure, so we cannot guarantee absolute security. We retain Personal Data for as long as you have an account with us or as necessary to provide the Services, and for longer where necessary to comply with our legal obligations, resolve disputes, or enforce our agreements.
We do not knowingly collect or solicit Personal Data from children under 18 years of age. If you are a child under 18, please do not use the Services or send us any Personal Data. If we learn we have collected Personal Data from a child under 18, we will delete it as quickly as possible. If you believe a child under 18 may have provided us Personal Data, please contact us at privacy@sakurahealth.ai.
Depending on where you live, you may have rights regarding your Personal Data, including the right to know what Personal Data we hold about you, to request access or deletion, and to opt out of certain sharing. California residents: under California law, you may request that we not disclose your Personal Data to third parties for their direct marketing purposes, and you may exercise the access, deletion, and opt-out rights provided under the California Consumer Privacy Act, as amended. We do not sell your Personal Data. To exercise any of these rights, contact us at privacy@sakurahealth.ai.
